El lector se encontrará en el presente trabajo con dos capítulos en los cuales se aborda de manera clara e histórica el proceso de codificación europea en el periodo del iluminismo o siglo de las luces, sobre todo en lo que tiene que ver con la codificación en materia de Derecho Penal, en el segundo capítulo se aborda esa influencia del proceso de codificación europeo en el proceso de codificación en América Latina, haciendo énfasis en el impacto de dicho proceso (...) en la expedición de Primer Código Penal de 1837 de la República de la Nueva Granada esto a la luz de los aportes de dos estudiosos y juristas europeos: Cesare Bonesana Marqués de Beccaría y Jeremy Bentham. El presente artículo es el resultado de un proceso de investigación originado en la Maestría en Publicidad de la UTL, en la línea de Semiótica Publicitaria, dirigida por el profesor Vladimir Sánchez, quien en su seminario, ha venido construyendo un equipo de trabajo con los maestrantes en torno a la aplicabilidad de algunos de los postulados de la pragmática de Charles Sanders Peirce al campo publicitario. Los maestrantes Jairo Sojo y Juan José Arango, adelantaron algunas hipótesis sobre el (...) trabajo del profesor Sánchez, y, gracias a ello, se propuso a la UJTL y a la Universidad Santo Tomás, un proyecto interinstitucional de investigación titulado “Semiótica, planeación y estrategia publicitaria y de diseño. Proyecciones del Pragmatismo a la comunicación contemporánea”. En el marco de la investigación anteriormente mencionada, surge el artículo que aquí se presenta, como un primer planteamiento de las hipótesis de investigación que dan origen a dicho proceso y que pueden esbozarse en tres grandes aspectos. El primero, unas consideraciones generales sobre el pragmatismo desde una perspectiva publicitaria con énfais en la regla de cualificación planteada por Peirce en 1903. El segundo, la propuesta de un modelo de análisis de piezas publicitarias desde la operacionilización de la regla de cualificación. El tercero una modelación para la planeación de estrategias publicitarias a través de la regla de cualificación aplicada al cruce de los interpretantes ontológicos y los interpretantes modales. For millennia it has been discussed whether literature appropriately can or should be used in education for a moral purpose. Taking as a premise that it can actually be educative and not merely moralising, we tackle the case made against such use, based on the claim that it would be perverting the aesthetic nature of literature as a form of art, as it would be instrumentalised. Given that this claim is based on a dichotomy between an aesthetically educative approach and (...) a morally educative approach to literature, we examine how warranted such a formulation of this dichotomy is. We argue that, at least on some occasions, those two educative approaches to literature—the aesthetic and the moral—can actually be mutually reinforcing in such a way that aesthetic appreciation will suffer if the moral is not deeply examined with both mind and heart, and vice versa. This does not mean, however, that this relation of mutual contribution will always obtain in a neat way. It may actually be the case that just in a few cases, and only if carried out in a pedagogically appropriate manner, it will be correct to use literature with a morally educative purpose. (shrink)

Undoubtedly, democracy is in constant danger. The Athenian creation -later taken by the Latin American countries in the political-administrative figure of the Republic- has demonstrated not to be the best government model, but, the less evil, as expressed by an English politician when he saw that his empire era was coming to an end. And one of those defenders was the critical acid of the Vienna Circle and contemporary philosopher Karl Popper, who lived on his own flesh the mistakes of (...) democracy and the horrors of totalitarianism. Popper, defender of democracy to the limit, who even within his writings we can appreciate the paradoxes he sees in this, will not hesitate when the system of government of the people, for the people and the people, fall into the temptation to choose the dictatorship. For this, the philosopher tells us, democracy must create mechanisms so that this does not happen and we do not have a popular election that takes a demagogue and criminal to power, as was Hitler’s Germany. The thinking of the critical philosopher of historicism is liberal. An English liberalism and not as we understand it and we live in several States of America, where people is economic liberal and conservative in the ideas. No, Popper is liberal. A true liberal. Este trabajo propone explicar, a partir de la metodología propuesta por la Comisión Europea en el “Manual para la Perspectiva de género”, por qué las mujeres rurales víctimas del conflicto armado en Colombia se constituyen como un grupo especialmente vulnerabilizado y cuáles son las principales barreras a las que se enfrentan al momento de reclamar su derecho a la restitución de tierras, específicamente en los programas que se vienen desarrollando en el marco de la Ley 1448 de 2011.

The article considers the basic arguments of some “critics of epistemology”, according to which the philosophical analysis of the problems associated with the processes of cognition (including science) should be eventually replaced by the study of these problems by means of special cognitive sciences. It is shown that these arguments are in part incorrect and in part can be seen as an indication of the real difficulties in the modern philosophy of cognition. A future philosophical epistemology is associated with the (...) reform of its conceptual apparatus, the methodological arsenal and problem field. An interaction between epistemology and the sciences dealing with cognition is the only and necessary way of development for philosophical epistemology. There are two ways of such interaction. Firstly, there is an analysis of scientific discussions, on the basis of which one identifies new opportunities to overcome the well-known philosophical controversies (between rationalism and empiricism, realism and constructivism, fundamentalism and relativism, etc.). On this way, epistemology moves into a position of horizontal moderation of interdisciplinary discourse and creates a trading (Harry Collins). Secondly, epistemology provides a rational criticism of the foundations of special sciences, and selects semantic levels in the content of its own categories (truth, rationality, agent, object, etc.) referring to different cognitive practices. These practices are evaluated normatively in terms of a value perspective of modern culture. Both ways are complementary to each other. (shrink)

Este manuscrito pretende plantear dos ideas: la primera problematiza el origen de la universidad en tanto creación humana en sentido pragmático (Kant, 1800), para luego abordarlo en perspectiva histórica desde tres momentos: Medieval, Clásico y Ancestral, retomando autores como Rashdal (1895), Haskings (1923), Ureña (1919), Ribeiro (1971) y Dussel (2004); posteriormente se plantea el origen de la universidad más allá de su historicidad, en el interior del ser humano como cultivo de la virtud y el conocimiento poiesis en Platón (380 (...) a.C/1999). La segunda idea implica comprender que desde su origen la universidad como politeia desde la apropiación de algunos planteamientos aristotélicos (s,f/1883) y arendtianos (1997), ha posibilitado pensarse como un escenario de movilización social o continuidad del orden social establecido, donde se reflexiona críticamente en la necesidad de actualización de la universidad entre poiesis y politeia como potencia para recuperar su sentido primigenio, en tanto actitud que brota del interior del ser humano. A significant number of current developments in the field of Biotechnology –such as stem cells, in vitro fertilization, embryo research, cloning, among others– are related directly or indirectly to the beginning of human life. It is important to acknowledge the biological status of the human embryo: when does its life begin and what is it from a biological standpoint. Therefore, by considering such information, informed choices could be made in moral and legal issues. The different biological processes of fertilization are (...) presented, noting particularly when human life begins. Appearing here in English for the first time, Vladimir Jankélévitch's Henri Bergson is one of the two great commentaries written on Henri Bergson. Gilles Deleuze's Bergsonism renewed interest in the great French philosopher but failed to consider Bergson's experiential and religious perspectives. Here Jankélévitch covers all aspects of Bergson's thought, emphasizing the concepts of time and duration, memory, evolution, simplicity, love, and joy. A friend of Bergson's, Jankélévitch first published this book in 1931 and revised it in 1959 to (...) treat Bergson's later works. This unabridged translation of the 1959 edition includes an editor's introduction, which contextualizes and outlines Jankélévitch's reading of Bergson, additional essays on Bergson by Jankélévitch, and Bergson's letters to Jankélévitch. Focusing on three historical examples of a different understanding of Christian identity, the paper seeks to address the role of contemporary concepts of sex and gender in the creation of Christian identity. In the first case study, focused on the literary representations of the Christian martyrdom from the second and third centuries, special emphasis is placed on the demand for the?manly? or?masculine? way of witnessing faith. The second historical example relates to the creation of a wider ascetic movement in the (...) fourth-century Asia Minor, and its specific focus is on Macrina the Younger. In her Vita, Gregory of Nyssa distinguishes between Macrina?s gender identity based on her virginity on the one hand, and her social role as a widow, and?mother? and?father? of her monastic community on the other. Finally, the focus is shifted towards Dionysius the Areopagite and Maximus the Confessor, whose teachings about ecstasy, as a way to transcend oneself in the movement towards the loved one, provide the basis for establishing a theology of marriage and creating a Christian identity based not on sexual or gender roles, but on the uniqueness of human nature. Though written corporate codes of ethics have been touted as a panacea for the embarrassments and uncertainties of the past two decades, the absence of clear evaluation procedures severely compromises their usefulness. An ethnographic study comparing development processes and compliance outcomes in large health care facilities and energy companies shows that neither of the two industries has encountered much success with a codes of ethics program. Companies that distribute copies of their code of ethics seldom ensure the process is completed (...) or that employees understand the purpose of the document, and staff responsible for the code give it a low priority relative to their overall responsibilities. Contrary to expectations, health care facilities are no more likely to develop or implement codes of ethics effectively than are energy companies. More extensive research is needed in order to generate the data necessary for the development of realistic standards for the evaluation of codes of ethics. (shrink)

Two main theories about metacognition are reviewed, each of which claims to provide a better explanation of this phenomenon, while discrediting the other theory as inappropriate. The paper claims that in order to do justice to the complex phenomenon of metacognition, we must distinguish two levels of this capacity—each having a different structure, a different content and a different function within the cognitive architecture. It will be shown that each of the reviewed theories has been trying to explain only one (...) of the two levels and that, consequently, the conflict between them can be dissolved. The paper characterizes the high-level as a rationalizing level where the subject uses concepts and theories to interpret her own behavior and the low-level as a controlling level where the subject exploits epistemic feelings to adjust her cognitive activities. Finally, the paper explores three kinds of interaction between the levels. (shrink)

Mind-wandering seems to be paradigmatically unintentional. However, experimental findings have yielded the paradoxical result that mind-wandering can also be intentional. In this paper, we first present the paradox of intentional mind-wandering and then explain intentional mind-wandering as the intentional omission to control one’s own thoughts. Finally, we present the surrealist method for artistic production to illustrate how intentional omission of control over thoughts can be deployed towards creative endeavors.

Recent debates on mental extension and distributed cognition have taught us that environmental resources play an important and often indispensable role in supporting cognitive capacities. In order to clarify how interactions between the mind –particularly memory– and the world take place, this paper presents the “selection problem” and the “endorsement problem” as structural problems arising from such interactions in cases of mental scaffolding. On the one hand, the selection problem arises each time an agent is confronted with a cognitive problem, (...) since she has to choose whether to solve it internally or externally. How does she choose? On the other hand, when confronted with the internally or externally retrieved solution to a cognitive task, the subject has to decide whether to endorse the information. How does the subject decide whether to endorse it or not? The last section proposes a solution to each problem in terms of metamemory and metacognitive feelings. Metamemory evaluates memory each time the subject is confronted with a memory task and elicits either a positive or negative metacognitive feeling that guides the decision. (shrink)

The aim of this book is to present the fundamental theoretical results concerning inference rules in deductive formal systems. Primary attention is focused on: admissible or permissible inference rules the derivability of the admissible inference rules the structural completeness of logics the bases for admissible and valid inference rules. There is particular emphasis on propositional non-standard logics (primary, superintuitionistic and modal logics) but general logical consequence relations and classical first-order theories are also considered. The book is basically self-contained and special (...) attention has been made to present the material in a convenient manner for the reader. Proofs of results, many of which are not readily available elsewhere, are also included. The book is written at a level appropriate for first-year graduate students in mathematics or computer science. Although some knowledge of elementary logic and universal algebra are necessary, the first chapter includes all the results from universal algebra and logic that the reader needs. For graduate students in mathematics and computer science the book is an excellent textbook. (shrink)

En este trabajo de investigación se recoge y analiza una información bibliográfica valiosa sobre la inmortalidad del alma en el Estagirita según Suárez. Es sorprendente la amplitud de conocimiento sobre la historia de la filosofía del Doctor Eximio, que le sirve de inspiración y apoyo en el análisis de las fuentes, ya sea directa o indirectamente por referencia de otros. Así, hay tres referencias indirectas: Eusebio de Cesarea, Agustín Eugubino y Agustín Nifo. Las fuentes de inspiración del filósofo español sobre (...) el status quaestionis son treinta autores en total. De ellos, dieciséis autores a favor de la mortalidad del alma en Aristóteles; once autores a favor de la inmortalidad en el Estagirita y tres que mantienen una posición ambigua o dudosa en Aristóteles. En efecto, el pensamiento de este elenco de pensadores –desde la antigüedad hasta el siglo XVI– citados por el jesuita, forma realmente una historia de la inmortalidad del alma humana. (shrink)
